TERMS AND CONDITIONS
1. Promotion being conducted by Property Central Group Pty Ltd ABN 26 137 221 982 of [56 Terrigal Esplanade, Terrigal NSW 2260. Phone 02 4385 6423. (Promoter)].
2. Information on how to enter and prizes form part of these terms and conditions. By entering this promotion entrants acknowledge that they have read, understand and agreed to be bound by these terms and conditions.
3. Participation is only open to customers over 18 years of age who complete the survey during the period of the Promotion. Employees of the Promoter (and their immediate families) are ineligible.
4. To enter, customers must send the completed survey to the Promoter. Surveys will be entered into that months promotion in which they were received.
5. Promotion commences at [9:00am] AEST on Thursday 1 October 2009.
6. A draw for a $100 Myers gift voucher will be conducted at 9:00am on the 1st day of each month at Property Central, 56 Terrigal Esplanade, Terrigal NSW 2260. Should that day be a weekend or public holiday, the draw will take place the next business day. Voucher winners will be notified by telephone. The winners will also be published at [www.propertycentral.com.au].
7. The Promoters decision on each draw is final and no correspondence will be entered into. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
8. Prizes are not transferable or exchangeable and cannot be taken as cash.
9. Entries will be deemed to be accepted at the time of receipt. Surveys will be entered into that month’s promotion in which they were received. Incomplete entries will be deemed invalid. The Promoter accepts no responsibility for late, lost or misdirected entries.
10. Only one entry permitted per customer.
11. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury suffered or sustained, as a result of accepting any prize, except for any liability which cannot be excluded by law.
12. The Promoter reserves the right in its sole discretion to disqualify any individual who it has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
13. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law, and subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
14. All entries become the property of the Promoter. All personal details of entrants will be stored at the Promoter’s head office. Personal information of the winner(s) may be disclosed to State lottery departments as required by law. The Promoter may also use and disclose personal information for the purpose of providing entrants with information concerning its products and services. All entrants have the right to access, update or correct any information. All such requests should be directed to the Promoter. A copy of the Promoter’s privacy policy in relation to the treatment of personal information collected may be obtained from [www.propertycentral.com.au].
